Ratio Decidendi

The Court found that while the applicant had demonstrated the existence of an arguable appeal, the second limb of the test under Rule 5(2)(b)—that the appeal would be rendered nugatory if stay is not granted—was not satisfied. This was because the respondent had already executed the decree and received full payment of the decretal sum from the applicant prior to the hearing of the application. As a result, there was nothing left for the Court to stay, and the application for stay of execution had been overtaken by events. The Court therefore dismissed the application with costs to the respondent.
