The Court further held that if stay of execution was not granted, the appeal would be rendered nugatory because the respondent may not be able to refund the sums ordered if the appeal succeeds. The Court was satisfied that the criteria for granting stay under Rule 5(2)(b) had been met and therefore allowed the application for stay of execution pending the hearing and determination of the appeal.
