Ratio Decidendi

In this case, only the 1st Contemnor was served with the court order, and there was no evidence that any of the Contemnors were served with the penal notice. The penal notice was not stamped as received, and its authenticity was questionable due to differences in font and presentation. Since the required service was not effected, the application for leave to commence contempt proceedings could not succeed. The court therefore refused the leave sought and dismissed the application.
