Ratio Decidendi

The court found that while Rule 7 of the Auctioneers Rules, 1997, generally places the obligation to pay auctioneer's charges on the judgment debtor, it would be unjust to require payment in circumstances where the underlying judgment has been set aside due to irregular service and no blame is attributable to the appellant. The judgment that gave rise to the auctioneer's charges was annulled once the appellant complied with the conditions for setting aside. Furthermore, the assessment of the auctioneer's charges did not comply with the prescribed method under the Fourth Schedule, which entitles the auctioneer only to half the fees plus expenses if the sale is stayed or postponed....
