Ratio Decidendi

The Court held that review of a judgment is only available where no appeal has been preferred or is allowed. In this case, the Respondent had already filed a notice of appeal, thus depriving the Court of jurisdiction to entertain a review application. Furthermore, the Court found no error apparent on the face of the record, as the prayers in the amended claim were considered and reasons for declining them were provided in the original judgment. The mere fact that the Court did not grant all the prayers sought does not constitute an error or omission. The application for review was therefore dismissed for lack of merit.
