Procedural Posture

Employment and Labour Cause / Ruling on Effective Date of Collective Bargaining Agreement

  1. 1 Whether the effective date of the new Collective Bargaining Agreement (CBA) should be backdated to January 2021 or set as the date of execution and registration.
  2. 2 Whether the court can impose a retroactive effective date for the CBA in the absence of consensus between the parties.

Ratio Decidendi

The court held that under the Labour Relations Act, 2007, a collective bargaining agreement (CBA) only becomes enforceable upon registration by the court and is effective from the date agreed upon by the parties. In the absence of such agreement, the effective date defaults to the date of execution and registration. The court found that the parties had not reached consensus on a retroactive effective date, and thus, it could not impose one. The law generally prohibits the retrospective enforcement of contractual rights unless both parties concur. Therefore, the benefits under the new CBA can only be implemented prospectively from the date of execution and registration, and not backdated...

Court Disposition

Application dismissed; effective date of CBA to be date of execution and registration.

Orders

  • The effective date of the proposed CBA shall be the date on which the instrument is executed and registered by the court.
  • Each party shall bear its own costs.
