The court was not satisfied that the plaintiff was entitled to unilaterally increase the interest rate from 5% to 24% per annum in the absence of the original loan or mortgage documents. Therefore, judgment was entered for the principal sum of Kshs.160,073.00 with interest at the contractual rate of 5% per annum from 1st March 1985 to 3rd May 1999 (date of suit), and thereafter at court rates until payment in full. The plaintiff was also awarded costs of the suit.
