Ratio Decidendi

The Court of Appeal found that the applicant had satisfied the two limbs required for grant of stay under rule 5(2)(b) of the Court of Appeal Rules: first, that the intended appeal is arguable, particularly on the ground that the trial court may have failed to properly evaluate the evidence regarding the respondent's termination; and second, that the appeal would be rendered nugatory if stay is not granted, as the respondent is unlikely to be able to refund the compensation if the appeal succeeds. The court therefore allowed the application for stay of execution of the judgment pending the hearing and determination of the intended appeal.
