Procedural Posture

Preliminary Objection / Ruling on Preliminary Objection Regarding Limitation of Actions

  1. 1 Whether the suit is barred by limitation of actions under section 90 of the Employment Act 2007.
  2. 2 Whether part payment and acknowledgement by the respondent revived or shifted the accrual date of the cause of action.
  3. 3 Whether the claimant was entitled to file suit after the conciliation process.

Ratio Decidendi

The court held that the respondent's part payment and acknowledgement of the claimants' terminal benefits in 2015 had the effect, under sections 23, 24, and 25 of the Limitation of Actions Act, of reviving and shifting the accrual date of the cause of action to the date of such payment and acknowledgement. Therefore, the claim was not time barred under section 90 of the Employment Act 2007. The court further found that the claimant had properly reported the dispute to the Minister for Labour and could not file suit before the conclusion of the conciliation process. As a result, the preliminary objection by the respondent was dismissed as lacking merit.
