Therefore, the Claimant's failure to refer the dispute for conciliation does not render the claim fatally defective, and the Court retains jurisdiction to hear the matter. The Preliminary Objection raised by the Respondents, premised on lack of jurisdiction and procedural breaches, was not merited. The Court directed that the claim should proceed to hearing on its merits, and interim orders were extended.
