The disciplinary process was procedurally flawed, with the grievant being given insufficient notice and the charge being introduced late in the process, contrary to the requirements of section 41 of the Employment Act. The respondent’s failure to follow fair procedure and to prove the alleged misconduct rendered the dismissal wrongful and unfair. Consequently, the grievant was entitled to compensation for unfair dismissal and salary in lieu of notice, but not gratuity, as no basis for the latter was established.
