The court found that the balance of convenience, including the location of the cause of action, residence of the Defendants and their witnesses, and the Plaintiff's branch at Kisii, justified transferring the suit to Kisii. The Plaintiff's stated fears for filing in Nairobi were not substantiated. The court therefore granted the application and directed that the suit be tried at the High Court, Kisii, with the record to be transferred accordingly.
