The court found that the cause of action arose in Kisii, the Defendants and their witnesses are based there, the relevant lower court record is in Kisii, and the Plaintiff has a branch there. The Plaintiff's stated fears for filing in Nairobi were not substantiated. The balance of convenience and the interests of justice dictated that the trial be held at Kisii. Accordingly, the application to transfer the suit to Kisii was granted.
