The Tribunal found that it has jurisdiction to entertain an application for stay of proceedings under Order 42 Rule 6 of the Civil Procedure Rules. However, the applicant failed to demonstrate sufficient grounds or exceptional circumstances to warrant the grant of a stay. The Tribunal noted the absence of evidence showing diligent prosecution of the appeal and characterized the application as unreasonable, made in bad faith, and causing undue delay. The Tribunal emphasized the principle that litigation must come to an end and that the decree holder should be allowed to enjoy the fruits of judgment.
