Ratio Decidendi

The court found that the respondent terminated the grievant's employment before the expiry of her contract without providing any reason or subjecting her to a fair hearing, in contravention of Sections 41 and 43 of the Employment Act, 2007. The respondent's reliance on the contractual notice clause was insufficient, as statutory requirements for substantive and procedural fairness must still be met. The absence of a valid reason and failure to follow due process rendered the termination unlawful and unfair. Consequently, the claimant was entitled to compensation for unlawful termination as provided by law.
