Ratio Decidendi

The court found that the termination of the Grievant's employment was unfair, as the 1st Respondent failed to provide sufficient justification and disregarded the advice of the 2nd Respondent, its principal. However, reinstatement was deemed unsuitable and impracticable due to the passage of time since termination and the Grievant having reached retirement age. The court determined that compensation equivalent to 12 months' gross salary was appropriate as an alternative remedy. The court also awarded costs of the litigation and interest at 14% per annum from the date of termination, but declined to award costs of conciliation, as there is no legal provision for such costs.
