The court determined that the effective date of termination for the grievants is the date of judgment, 5th June 2020, as the respondent paid salaries up to May 2020 and interim orders maintained the employment relationship until judgment. The grievants are entitled to all salary increments and allowances awarded to serving employees up to the date of termination, as they remained employees until then. Gratuity is to be computed at 45 days for each year of service as per the registered CBA, and not on the basis of any separate negotiation.
