Ratio Decidendi

The court found that the claim for terminal dues is not dependent on the validity or otherwise of the 2017 Collective Bargaining Agreement, which is the subject of dispute in ELRC CBA No. 267 of 2017. The court held that the employment relationship and the claim for terminal dues can be determined based on the contract of service or, if necessary, the terms of the previous CBA dated 1st May 2013. The application for stay was therefore deemed frivolous and an abuse of the court process, as it would only serve to delay the prosecution of the main suit. The court dismissed the application with costs to the claimant.
