Ratio Decidendi

The court found that the cause of action arose on 7th February 2018 and the suit was filed on 21st February 2022, which is more than one year after the lapse of the statutory three-year limitation period set by section 90 of the Employment Act. The court held that the limitation period is mandatory and cannot be extended, even if the parties were engaged in conciliation or negotiations. As a result, the court lacked jurisdiction to hear and determine the suit, and the suit was struck out with costs. The court did not find it necessary to determine the issue of pecuniary jurisdiction, having already found the suit time barred.
