Ratio Decidendi

The court found that the claimant was terminated without being given an opportunity to be heard, in violation of the right to a fair hearing as enshrined in Article 50(1) of the Constitution, ILO Principle 119, and Section 41(1) of the Employment Act. The respondent failed to follow due process by suspending and dismissing the claimant without a show cause letter or a hearing. As a result, the termination was deemed unfair and wrongful. The court converted the wrongful termination into a normal one and awarded the claimant compensation as per the CBA, including notice pay, damages for unfair dismissal, service pay, and a certificate of service.
