The Respondent failed to produce written contracts or credible evidence to support its claims that the 2nd Grievant was in management or that her salary was consolidated. The 2nd Grievant's union membership was established by her membership card, and the law allows direct payment of union dues. The 1st Grievant was entitled to salary arrears for the period his pay was below the CBA rate and gratuity for his years of service, less notice pay as he failed to give proper notice.
