The court found that while there were valid reasons for the employer to consider dismissal based on the grievant's conduct, the respondent failed to prove that due process was followed. There was no evidence of a disciplinary hearing, no invitation letter, and no minutes produced to show that the grievant was given an opportunity to defend himself as required by Section 41 of the Employment Act. The absence of procedural fairness rendered the dismissal unfair and unjustified under Section 45 of the Employment Act.
