Procedural Posture

Stay Application / Ruling on Application for Stay of Sentencing Pending Appeal

  1. 1 Whether the court should grant a stay of sentencing pending the determination of an intended appeal.
  2. 2 Whether the applicant has satisfied the conditions for stay of execution in contempt proceedings.

Ratio Decidendi

The court found that the applicant had demonstrated the filing of a notice of appeal and that proceeding with sentencing before the appeal is determined could render the appeal nugatory, particularly as the Vice Chancellor's liberty was at stake. The court held that it has the discretion to grant a stay of sentencing in contempt proceedings to preserve the right of appeal and prevent irreparable harm. The absence of prejudice to the claimant and the risk of irreversible consequences to the applicant justified the grant of stay. The court therefore allowed the application for stay of sentencing pending the determination of the appeal, with costs to abide the outcome of the appeal.

Court Disposition

Application for stay of sentencing pending appeal allowed.

Orders

  • Stay of sentencing of the Vice Chancellor of the respondent pending determination of the appeal.
  • Costs of the application to abide the outcome of the appeal.
