Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the summary dismissal of the Grievant was justified under the applicable law and collective bargaining agreement.
  2. 2 Whether the Grievant is entitled to terminal benefits and if so, the quantum thereof.

Ratio Decidendi

The court found that while the Grievant was found asleep at the workplace and could not be raised on the radio, the misconduct did not rise to the level justifying summary dismissal, especially considering his long service and only one prior warning. The court accepted the recommendation of the Joint Industrial Council to reduce the dismissal to normal termination. As the full collective bargaining agreement was not provided, the court limited the award to four months' pay in lieu of notice and other terminal benefits as itemized in the dismissal letter, less lawful deductions. The court substituted the summary dismissal with normal termination and ordered payment of the assessed benefits.

Court Disposition

Summary dismissal substituted with normal termination. Grievant awarded terminal benefits.

Orders

  • The summary dismissal of the Grievant is substituted with normal termination.
