Ratio Decidendi

The court found that the dispute is a trade dispute between a trade union and an employer, which falls squarely within the jurisdiction of the Employment and Labour Relations Court under Section 62 of the Labour Relations Act, 2007. The delegation of jurisdiction to the Magistrates' Courts for claims involving employees earning less than Kshs. 80,000 does not apply to trade disputes, as expressly excluded by Gazette Notice No. 6024. The previous suit was struck out with liberty to refile, so the court is not functus officio. The preliminary objection, premised on lack of jurisdiction, is therefore without merit and is dismissed.
