Without a simple majority, the Claimant could not insist on recognition or demand CBA negotiations. Additionally, the court held that agency fees could not be levied without a ministerial order, which the Claimant had not procured. The withdrawal of union membership by employees was found to be in compliance with the Labour Relations Act. Consequently, the Claimant's claim for agency fees and for compelling CBA negotiations failed.
