Procedural Posture

Employment Cause / Ruling on Application to Set Aside Dismissal for Want of Prosecution

  1. 1 Whether the court should set aside the dismissal of the cause for want of prosecution due to alleged non-service of the show cause notice.
  2. 2 Whether the claimant made a frank and honest disclosure regarding receipt of the show cause notice.
  3. 3 Whether the delay in bringing the application to set aside dismissal was explained and justified.

Ratio Decidendi

The court found that the claimant failed to provide a frank and honest disclosure regarding the receipt of the show cause notice, as the supporting affidavit did not come from an official of the claimant union nor did it disclose the source of information about non-receipt. Furthermore, the claimant delayed for over six months before seeking to set aside the dismissal and failed to explain this inordinate delay. The court concluded that the claimant had not met the threshold for the exercise of judicial discretion in its favour and therefore declined to set aside the dismissal.

Court Disposition

Application to set aside dismissal refused; motion dismissed.
