The court held that the claim was statute barred, as it was filed nearly eight years after the cause of action accrued on 30th April 2008, well beyond the six-year limitation period prescribed by Section 4(1) of the Limitation of Actions Act. The court found that the commencement of conciliation or alternative dispute resolution processes under the Labour Relations Act does not suspend or affect the running of time for limitation purposes. The court further held that a union cannot continue to represent a deceased employee in the absence of a duly appointed legal representative. Consequently, the preliminary objection was upheld and the suit was struck out for being time barred.
