Ratio Decidendi

The court found that the Deputy Registrar's orders dated May 19, 2022, were consistent with the previous rulings of Wasilwa, J, which had determined the scope of agency fees and permitted execution for arrears owed by non-members, but not from employees who had resigned and joined another union. The application to set aside the Deputy Registrar's orders was therefore without merit, as the issues raised had already been conclusively determined and were res-judicata. The Deputy Registrar did not exceed her jurisdiction, and the orders for execution were properly issued in line with the court's earlier decisions. The application was dismissed with costs to follow the event.
