Ratio Decidendi

The Court found that both Leonard Kihara and Eric Mbugua were not given an opportunity to be heard prior to their dismissal/termination, contrary to Section 41 of the Employment Act 2007. For Leonard Kihara, although the dismissal was on grounds of irregularities and fraud, there was no evidence of a hearing. However, since he had signed a discharge form and was paid salary up to April 2009 (more than one month after dismissal), the Court limited compensation to two months' gross salary. For Eric Mbugua, the Court rejected the Respondent's argument that he was an independent contractor, finding that he was in continuous employment and entitled to the protections of the Employment Act....
