The court held that the respondent's preliminary objection did not raise a pure point of law and was therefore improperly raised. Guided by the principle that mistakes should not prevent a party from having their case heard on the merits, and that any inconvenience to the respondent could be compensated by costs, the court exercised its discretion to set aside the dismissal and reinstate the suit. The court imposed throw away costs on the claimant as a condition for reinstatement.
