Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the respondent is entitled to a stay of execution of the judgment and decree pending appeal.
  2. 2 Whether the respondent should be ordered to deposit the decretal sum as security for the due performance of the decree.

Ratio Decidendi

The court found that the respondent's apprehension of substantial loss was not rebutted, as the claimant did not oppose the application and the grievants were unemployed, making recovery of the decretal sum uncertain if the appeal succeeded. The court further held that the respondent's willingness to deposit the entire decretal amount as security satisfied the requirement under Order 42 Rule 6(2) of the Civil Procedure Rules. In balancing the interests of both parties, the court exercised its discretion to grant a stay of execution on condition that the full decretal sum be deposited in court within 30 days, failing which the stay would lapse. No order as to costs was made.

Court Disposition

Application for stay of execution allowed on condition of deposit of decretal sum.
