Ratio Decidendi

However, the sum of Kshs.2,640,000 claimed by the applicant is also the subject of the main suit and has not been conclusively established as due at this interlocutory stage. Granting the order for payment or deposit of the sum would be premature and would effectively determine the substantive dispute without a full hearing. The court therefore dismissed the application and directed the parties to proceed to a full hearing for determination of the reliefs sought.
