The issues raised by the applicant had already been fully canvassed and settled by the Court of Appeal in Kenya Wildlife Service v Joseph Musyoki Kalonzo [2017] eKLR. Granting a stay would only serve to delay the lower court proceedings without sufficient justification. The high and stringent threshold for stay of proceedings was not met, and the application was therefore dismissed in the interest of justice and judicial efficiency.
