The appellant failed to specifically deny this assertion in its defence or controvert it during cross-examination. Therefore, the trial magistrate was justified in awarding damages for lost years. On the issue of damages for pain and suffering, the court held that the award of Kshs. 200,000 was reasonable and not inordinately high, considering the length of pain endured by the deceased. The appeal was thus dismissed for lack of merit.
