Ratio Decidendi

The Court found that although the notice of appeal and the record of appeal were filed out of time and without leave of the Court, the applicant's application to strike out the record of appeal was itself filed outside the mandatory 30-day period stipulated by rule 84 of the Court of Appeal Rules. The rule is expressed in mandatory terms and does not grant the Court discretion to extend the period for filing such applications. As a result, the application was incompetent and could not be entertained, regardless of the merits of the underlying complaint about the late filing of the appeal. The applicant's failure to act within the prescribed time frame was fatal to the application.
