The court found that the applicant's attempt to enforce the Director's initial award of Kshs 1,205,452.80 was not tenable because uncontroverted evidence showed that the award had been revised by the Director of Occupational Safety and Health Services to Kshs 226,022.40, and that this revised sum had already been paid to the applicant. The applicant did not dispute receipt of the payment, and the advocate's affidavit was found to have no probative value against the direct evidence of payment. Consequently, there was no enforceable unpaid award, and the application was dismissed with costs to the respondent.
