Procedural Posture

Miscellaneous Application / Ruling on Application for Review of Court Directions and Leave to Orally Address Court

  1. 1 Whether the court should review its previous directions/orders issued on 21st February 2024.
  2. 2 Whether the applicant should be granted leave to orally address the court on the application dated 7th August 2023.
  3. 3 Whether the court has jurisdiction to determine issues arising from contradictory DOSH awards under a miscellaneous application.

Ratio Decidendi

The court held that it lacked jurisdiction to determine issues arising from contradictory awards by the Director of Occupational Safety and Health under a miscellaneous application, as such matters must first be addressed through the statutory objection process outlined in sections 51 and 52 of the Work Injury Benefits Act. The court further found that the applicant had not complied with previous directions to file written submissions and, therefore, there were no submissions on record to be highlighted. The application for review and leave to orally address the court was thus without merit both on procedural grounds and for want of jurisdiction. The application was dismissed with costs...
