Ratio Decidendi

The High Court determined that it lacks jurisdiction to entertain an application for extension of time to file an appeal to the Court of Appeal. The power to extend time for filing an appeal to the Court of Appeal is vested exclusively in the Court of Appeal under Rule 4 of the Court of Appeal Rules. The applicant's application, having been lodged in the High Court instead of the Court of Appeal, was therefore improperly before the court. Consequently, the application was struck out for want of jurisdiction, and the applicant was advised to pursue the application before the appropriate forum, namely the Court of Appeal.
