The High Court determined that the dispute before it concerned the nomination and gazettement of members to the County Assembly, which, according to binding Supreme Court and Court of Appeal authority, forms part of the electoral process. The law is clear that any challenge to such nominations, once gazetted, must be brought by way of an election petition before the designated Magistrate’s Court, not by constitutional petition in the High Court. The court found that it lacked jurisdiction to entertain the petition, as the proper forum for such disputes is the election court as provided under Section 75(1A) of the Elections Act.
