Ratio Decidendi

The trial court failed to conduct a proper plea as mandated by section 207 of the Criminal Procedure Code and the principles in Aden v R [1973] EA 445. There was no order of conviction before the sentence was pronounced, rendering the proceedings irregular and the sentence illegal. The High Court, exercising its revisionary jurisdiction under section 362 of the Criminal Procedure Code and Article 165(6) & (7) of the Constitution, found that the sentence was not based on any lawful conviction and must be set aside. The accused persons are to be presented before the Head of Station Makindu for the matter to be properly disposed of, considering the period already spent in custody.
