Ratio Decidendi

The High Court is barred from entertaining revision proceedings at the instance of a party who has a right of appeal but has not exercised that right. The applicant, having been convicted and sentenced, had the right to appeal the decision of the trial court. Since he did not file an appeal, the law prohibits the High Court from considering his application for revision. The merits of the applicant's complaints regarding the sentence are therefore not considered, and the application for revision is dismissed. The applicant retains the right to appeal the trial court's decision if he so chooses.
