The court found that the deceased was a Muslim and that his estate should be distributed in accordance with Islamic Sharia law, not traditional practices that exclude daughters from inheritance. The purported oral will was invalid as it was allegedly made more than two years before the deceased's death, contrary to section 9(1)(b) of the Law of Succession Act, and did not meet the requirements of Islamic law regarding oral wills. The trial court erred in excluding certain properties from the estate and in failing to recognize the appellants' rights as heirs.
