Civil Suit / Ruling on Jurisdiction

  1. 1 Whether the High Court has jurisdiction to hear and determine employment and labour relations disputes after the establishment of the Industrial Court under the Constitution of Kenya, 2010.
  2. 2 Whether the transfer of pending employment and labour relations cases to the Industrial Court violates the doctrine against retroactive application of the law.
  3. 3 Whether any vested rights or obligations of the parties are affected by the transfer of the case to the Industrial Court.

Ratio Decidendi

The High Court determined that, following the establishment of the Industrial Court under Article 162(2)(a) of the Constitution and the enactment of the Industrial Court Act, jurisdiction over employment and labour relations disputes is exclusively vested in the Industrial Court. The transitional provisions of the Constitution and the Industrial Court Act permit pending cases to be heard by the corresponding court established under the Constitution. The transfer of such cases does not violate the doctrine against retroactive application of the law, as no vested rights or obligations are divested or abrogated. The High Court's unlimited jurisdiction is expressly limited by Article 165(5)...

Court Disposition

The High Court lacks jurisdiction; the matter is to be transferred to the Industrial Court.
