The court found that the Applicants' delay in seeking leave to appeal was only eight days and was satisfactorily explained by the late receipt of the judgment. The intended appeal was found to raise arguable issues, and the Applicants offered a bank guarantee as adequate security for due performance. The court held that a bank guarantee from a reputable bank is sufficient security and that requiring a cash deposit would be unnecessarily disadvantageous to the Applicants, especially given the financial impact of the COVID-19 pandemic on the school.
