Although the respondent asserted that the claimant was a person of straw, no evidence was provided to support this claim. The claimant did not oppose the stay provided security was furnished. The court exercised its discretion to grant a conditional stay of execution, requiring the decretal sum to be deposited in a joint interest-earning account in the names of the parties' advocates, or in court if the parties could not agree on a bank, to secure the interests of both parties pending appeal.
