The Court of Appeal found that the applicants satisfied the two established principles for the grant of stay of execution pending appeal under rule 5(2)(b): (1) the intended appeal was arguable as it raised non-frivolous grounds regarding the distribution of the estate and the apportionment of rental proceeds; (2) the appeal would be rendered nugatory if stay was not granted, as the subject properties could be alienated and the applicants would suffer irreparable harm, particularly since the 7th respondent was not a person of means and recovery would be difficult.
