Ratio Decidendi

The Tribunal found that the claimant, as guarantor, was liable to the Sacco for the respondent's defaulted loan, and the Sacco was justified in deducting the loan repayments from her. However, once the Sacco recovered its monies from the guarantor, the guarantor was entitled to recover those sums from the principal debtor. The claimant produced uncontroverted evidence of monthly deductions totaling Kshs. 101,712 from January 2023. With no evidence to the contrary from the respondent, the Tribunal held that the claimant was entitled to a refund of the amounts deducted, together with costs and interest at Tribunal rates from July 2023 until payment in full.

Court Disposition

Claim allowed in favour of the claimant.

Orders

  • The respondent shall refund Kshs. 101,712 to the claimant, being the amount deducted so far from the claimant.
