The court found that the plaintiffs' cause of action arose on 24th May 2000, the date when they paid the full purchase price for the suit properties and became entitled to possession and transfer under the agreement for sale. According to Section 4(1) of the Limitation of Actions Act, actions founded on contract must be brought within six years from the date the cause of action accrued. The suit was filed on 21st December 2007, more than six years after the cause of action arose, and was therefore time barred.
