The Court of Appeal held that after the 1997 amendment to section 20(1)(a) of the National Assembly and Presidential Elections Act, both the presentation and service of an election petition must be effected within 28 days of the publication of the election result in the Gazette. Rule 14 of the Election Petition Rules, which allows service within 10 days of presentation, is in direct conflict with the statute and must give way to the clear statutory requirement.
